Deere v. Javitch, Block & Rathbone L.L.P.
413 F. Supp. 2d 886 (S.D. Ohio 2006). The Sixth Circuit described the statute as overwhelmingly broad and its terms must be literally enforced. The court cannot conclude, based upon two different court opinions, which Plaintiff is acting in bad faith by filing a suit. Court denied sanctions.

Lamb v. Javitch, Block & Rathbone, L.L.P.
2005 WL 4137778 (S.D. Ohio Jan. 24, 2005). The court found that MBNA�s law firm did not violate the FDCPA when it started arbitration by filing a claim with a court located outside of the state required by the signed agreement. Said arbitration was to be conducted in the consumer's locale.

They are rude and will not stop till they get u! they called my parents house and told them I was going to get arrested if I did not call them immediately. They said there would be a warrant issued. That stuff was all lies but it put my mother in tears and she almost had a heart attack.

Just received a letter for a "claim" for $11,000 saying my son was in an accident in California in August of 2010 - he hasn't even been in the state since 2007. TOTAL BOGUS!!!

I had found out that this firm is suppose to be with palisade collection and is collecting a debt for AT&T. I had never had any thing with that company. They sent a garnishment to my bank and took what little savings I had. I dont know how to go about this. If anyone has any suggestions please let me know.

Worried Sick

I have received notification that i owe these individuals $10,000 collecting on a fraudulent insurance claim made against me over a year ago, this insurance company never contacted me and i have no idea where i turn for aid with this. I'm a 20 year old recent high school graduate with NO MONEY and between employment, i don't even know what i can do to defend myself at the moment. Any advice?
