183 F. Supp. 2d 1234 (D.Haw. 2002). The consumer argued that their was a discrepancy in the amount that the debt collector was attempting to collect. The amount stated in the telephone conversation did not match the amount stated in the debt collection notice. Debt collector was able to explain that the high cost of the debt was a result of interest. Debt collector violated the FDCPA by misleading the consumer into believing that it was the consumer's responsibility to provide proof that they did not owe the debt.

I was contacted by Omni Credit Services and was harassed into setting up a payment when I explained to the representative that I did not have the funds until I got paid again two weeks later. She insisted that I had no more time and I gave her my checking account number. The payment did not go through because my account became overdrawn because of several other payments that I had. She now claims that I gave her a bad check when I already informed her that I would not have sufficient funds in my account until 10/14/11. I then was given the company's Western Union information and told her that I would make a payment using Western Union. She has since contacted me and threatned to send my case to the State office and hung up on me. This of course doesn't make any sense since I did inform her that the funds would not be available until 10/14/11, not on 9/30/11.
