What Should I Do
Make sure you get everything in writing. After contacting you, the collector must send you a written notice detailing what you owe, the creditor, and when it is owed. If you are getting calls from collectors, tell them to send everything in writing before you discuss further on the phone.
If you feel as if the debt is not owed or fraudulent, you can dispute the debt in writing. You can send a letter to the debt collectors within 30 days of first being notified of the collection. It is suggested that you send this letter via certified mail so that you have a record that they received it. If they find proof of your debt, they can start collection activities once again.
Try to keep records of all call, messages and letters. Keeping a file will help Francis and Mailman if a lawsuit is taken. Even keep track of day and time of day that calls were made.
These collectors cannot use abusive or obscene language, cannot call before 8am or after 9pm, cannot call repeatedly, cannot call you at work or best of all, they cannot contact you anymore if you have an attorney.
