What to do if a Debt Collection Agency Violates the FDCPA laws

The Fair Debt Collection Practices Act (FDCPA) brings protection to consumer that have to deal with overly aggressive and sometimes abusive debt collection agencies and their agents. If you feel like a debt collector has violated you and your rights, then there are steps that you can take to fight back against them. You have rights.

If the debt collection agency goes too far, you can sue them and even report them to government agencies.

Curious what laws these agencies must follow?

Learn the details of the Fair Debt Collection Practices Act here. All debt collectors must follow these rules when contacting you about debt that is owed. If they choice to use unethical practices when speaking to you, they could be subject to a lawsuit.

Called both my home and cell numbers. Left a message on my cell phone. Man identified himself as a Michael Lensworth trying to serve a summons on a Harold McCloud (of which I am not). Was told to contact CMG and associates (the above company was the closest match I could find). The return number was 716-210-7770. I called them and let them know I was not Harold McCloud. He apologized and said there would be no more calls. I would think that this company does not have their act together too well and would question any alleged debt they say you owe.

Received another call today as per above with voice mail message left. Internet search seems to show that this is a known scam attempt. Not sure what to do now to get it stopped. Some research has shown however that a Harold McCloud did have the same home phone number as I at some point (before July 2009) and that he is now in prison on felonies in another state.

Five months later, I am now getting very similar calls from a Debra Reed who states she is a licensed service locator trying to serve a summons. She left a voice message to this effect. She never stated a name on the summons nor who the filer was. The number of the “filing party” was 8554208338. This appears to belong to a Crosby Crane and Associates (or similar company) of either Buffalo or Lockport, New York. A google search on the number will turn up many scam attempts from this entity, along with illegal threats. This entity changes their company name, phone, and location every few months. They always insist that you pay THAT DAY electronically. Full disclosure: I do not know for sure that CMG Recovery Services has anything to do with these attempted scams, but only suspect this based on their name and location.
